The Petitioner, a Society running a religious institute and Hindu Temple, was occupying a land within the vicinity of the Sri Maha Bodhi in the sacred city of Anuradhapura. Later, with the dawn of the Buddha Jayanthi era of 1956, the Petitioner was relocated by giving a land, where the Petitioner also ran a school which was vested in the Government under the Assisted Schools and Training Colleges Act. Thereafter, the Petitioner was placed in possession of another land, where it operated a religious institute including a Temple, cultural centre, and restaurant. The excess land was blocked out and given to the 8th to 10th Respondents. Dispute arose between them with regard to the regularisation and legalisation of their possession by the Government on the recommendation of the Provincial Land Commissioner, which the Petitioner objected to. Held - Application dismissed on the basis that the Petitioner has no legal title to claim nor any legitimate expectation to claim any title document since the Petitioner has failed to improve or develop the entire land; the Petitioner is not entitled to benefit out of his own fault. Though he was acquitted from criminal proceedings, he was charge-sheeted by a disciplinary panel appointed by the Senior DIG of the range to which he was attached. Panel of Inquiry found him guilty on the strong evidence against him; findings against him by the Panel of Inquiry was further affirmed by the Public Service Commission and Administrative Appeal Tribunal. However, on sympathetic grounds he was permitted to retire. The Petitioner challenges the vires of the appointment of Panel of Inquiry and its findings. Held – the Petitioner, being a Sub- Inspector, is subject to the disciplinary control of the Senior DIG of the range to which he is attached, therefore, the appointment is intra vires and based on the facts, the final findings of the AAT is justified; thus, Application dismissed.
