Hon. Dr. D. F. H. Gunawardhana, J. | The Petitioner made an application to the Debt Conciliation Board to have a debt settled on the basis that the Deed of Transfer on the face of it was only executed to secure a mortgage, which the Board declined after inquiry. The Petitioner invoked the jurisdiction of this Court challenging the same. Held – Since the Petitioner never parted with the possession of the land in suit after signing of the impugned deed, never intended to transfer the beneficial interest, and the huge disparity between the value of the property in suit and the consideration passed, writs issued as prayed for as the Board had erred in facts and in law. | The Constitution of the Democratic Socialist Republic of Sri Lanka | Download |

Hon. Dr. D. F. H. Gunawardhana, J. | The Petitioner challenges the decisions taken by the Debt Conciliation Board at three stages; namely, at the stage of accepting the application by a debtor after 21 years of the impugned deed of transfer, the stage of settling the disputing or issuance of the certificate in terms of Section 29(4), and the decision taken to refuse to revisit the decision already made in terms of Section 51(4) of the Ordinance. Held – the Petitioner is entitled to relief as sought since the Board failed to follow the rules of natural justice, consider the attended circumstances, the passage of time from the date of the transfer till the date of the application, and the refusal to revisit their own decision based on irrelevant material. | The Constitution of the Democratic Socialist Republic of Sri Lanka | Download |

Held – Application dismissed since notice under Section 31(2) had been issued and the Petitioner had never made an appeal against that to the Secretary to the line ministry, and the competent authority is of the opinion that the unauthorised structures should be removed and had accordingly delegated their authority to a recognised agent by the Act. | The Constitution of the Democratic Socialist Republic of Sri Lanka | Download |

Hon. D. F. H. Gunawardhana, J. | The original grantee died and his wife had not succeeded within six months of his death; she had sold her rights to a third party. In the meantime, the 4 th Respondent, the next of kin in the line of succession (the original grantee’s eldest son), was convicted for a triple murder which was later affirmed by the Supreme Court. Therefore, certain functionaries under the Land Development Ordinance, in the belief that he had lost his civil rights, pending the execution of his capital punishment imposed upon him, had decided to accept his younger brother as the next of kin and successor, and accordingly took steps to register his name erroneously. Thereafter, he has transferred his rights to the present Petitioner. The 4th Respondent made an application to succeed. On the advice of the Attorney General, the Commissioner General of Lands directed the 3rd Respondent (Divisional Secretary) to accept the 4th Respondent as the successor; the Petitioner challenged the same. Held – Application dismissed; the Attorney General’s advice is the correct; at certain times, certain functionaries under the Land Development Ordinance, having misread and misinterpreted the legal provisions, had misapplied them. | The Constitution of the Democratic Socialist Republic of Sri Lanka | Download |

Hon. Dr. D. F. H. Gunawardhana, J. | The Petitioner was an Attorney-at-Law attached to the legal division of the 1st Respondent Bank; was unduly and irrationally denied third extension after completing 57 years of service, which was challenged successfully; according to the judgement, she was reinstated from the date of the judgement. After reinstatement and service of two more years, at retirement she asked for the back- wages and other emoluments, which was denied; challenged the same. Respondents took up the position that there was a break in service; therefore, not entitled to back-wages during which she had not worked until she was reinstated. Held – break of her service was not caused by the Petitioner but by the Respondents; therefore, entitled to the back-wages and other emoluments. | The Constitution of the Democratic Socialist Republic of Sri Lanka | Download |

Hon. Dr. D. F. H. Gunawardhana, J. | The Petitioner claims that his uncle (3rd Respondent) failed to succeed to the rights as a successor of his late grandfather, who had been the original grantee of a parcel of land given under the Land Development Ordinance. However, the Respondents’ stand is that the 3rd Respondent could not have succeeded after the death of the original grantee in 1996 until the death of the spouse of the original grantee (mother of the 3rd Respondent) in terms of Section 48B. The question of succession arose thereafter in 2022, and the 3rd Respondent has duly applied to register his succession which had been nominated by the original grantee under the original permit issued prior to the grant. Held – acceptance of the 3rd Respondent as the successor by the Divisional Secretary on the instructions of the Commissioner General of Land is valid, and therefore, the registration in the Land Registry of the 3rd Respondent as the successor to the original grantee is valid; Application dismissed. | The Constitution of the Democratic Socialist Republic of Sri Lanka | Download |

Hon. Dr. D. F. H. Gunawardhana, J. | The Petitioner, a Society running a religious institute and Hindu Temple, was occupying a land within the vicinity of the Sri Maha Bodhi in the sacred city of Anuradhapura. Later, with the dawn of the Buddha Jayanthi era of 1956, the Petitioner was relocated by giving a land, where the Petitioner also ran a school which was vested in the Government under the Assisted Schools and Training Colleges Act. Thereafter, the Petitioner was placed in possession of another land, where it operated a religious institute including a Temple, cultural centre, and restaurant. The excess land was blocked out and given to the 8th to 10th Respondents. Dispute arose between them with regard to the regularisation and legalisation of their possession by the Government on the recommendation of the Provincial Land Commissioner, which the Petitioner objected to. Held - Application dismissed on the basis that the Petitioner has no legal title to claim nor any legitimate expectation to claim any title document since the Petitioner has failed to improve or develop the entire land; the Petitioner is not entitled to benefit out of his own fault. | The Constitution of the Democratic Socialist Republic of Sri Lanka | Download |

Hon.Dr. D. F. H. Gunawardhana, J. | An unlawful construction effected by the 8th Respondent was directed to be removed by the Local Authority on the complaints made by the Petitioners. However, the 8th Respondent did not comply; the Petitioners continued to complain even to higher authorities without any success. Finally, sought intervention of this Court, directing the Local Authority to take action against the 8th Respondent wrongdoer. The 8th Respondent took up the position that it is a private dispute and therefore, should go to the District Court to resolve the matter. Held – Local Authority is under a statutory duty entrusted to it; therefore, writ lies. | The Constitution of the Democratic Socialist Republic of Sri Lanka | Download |

Hon. Dr. D. F. H. Gunawardhana, J. | The Petitioner was involved in two robberies while serving as a police officer. Though he was acquitted from criminal proceedings, he was charge-sheeted by a disciplinary panel appointed by the Senior DIG of the range to which he was attached. Panel of Inquiry found him guilty on the strong evidence against him; findings against him by the Panel of Inquiry was further affirmed by the Public Service Commission and Administrative Appeal Tribunal. However, on sympathetic grounds he was permitted to retire. The Petitioner challenges the vires of the appointment of Panel of Inquiry and its findings. Held – the Petitioner, being a Sub- Inspector, is subject to the disciplinary control of the Senior DIG of the range to which he is attached, therefore, the appointment is intra vires and based on the facts, the final findings of the AAT is justified; thus, Application dismissed. | The Constitution of the Democratic Socialist Republic of Sri Lanka | Download |
