The Petitioner, a doctor attached to the Government, passed Part 1 of the Postgraduate examinations in the anesthesiology stream, completed the local training, and chose Australia for the foreign training – decided to resign in order to migrate, and was agreeable to pay the bonded amount. However, as he failed to report to work, his service was terminated and served with a vacation of post – the Government then claimed the bonded amount in addition to the expenditure incurred on his postgraduate studies. Two other candidates were also not appointed with the Petitioner; however, one of them was appointed pursuant to a successful Fundamental Rights application. The Petitioner thereafter resorted to alternative avenues and came before Court 20 years later, on an appeal made to the Administrative Appeal Tribunal (AAT). The AAT, while accepting the grievance, did not grant relief on the basis that it had not been established at the time - Application dismissed for delay.
