An application was made for mandamus, compelling the Divisional Secretariat to allocate land for a public playground — which had already been developed by a person without any valid permit or grant issued under the Land Development Ordinance, No. 19 of 1935 (as amended). However, the Divisional Secretary decided that the land had been developed without a valid permit or grant — therefore, the said land, though it remains state land, cannot be granted for public use, as the mango plantation created by the unpermitted possessor would be destroyed.
