Hon. D. F. H. Gunawardhana, J. | The original grantee died and his wife had not succeeded within six months of his death; she had sold her rights to a third party. In the meantime, the 4 th Respondent, the next of kin in the line of succession (the original grantee’s eldest son), was convicted for a triple murder which was later affirmed by the Supreme Court. Therefore, certain functionaries under the Land Development Ordinance, in the belief that he had lost his civil rights, pending the execution of his capital punishment imposed upon him, had decided to accept his younger brother as the next of kin and successor, and accordingly took steps to register his name erroneously. Thereafter, he has transferred his rights to the present Petitioner. The 4th Respondent made an application to succeed. On the advice of the Attorney General, the Commissioner General of Lands directed the 3rd Respondent (Divisional Secretary) to accept the 4th Respondent as the successor; the Petitioner challenged the same. Gunawardhana, J. | The Petitioner claims that his uncle (3rd Respondent) failed to succeed to the rights as a successor of his late grandfather, who had been the original grantee of a parcel of land given under the Land Development Ordinance. However, the Respondents’ stand is that the 3rd Respondent could not have succeeded after the death of the original grantee in 1996 until the death of the spouse of the original grantee (mother of the 3rd Respondent) in terms of Section 48B. The question of succession arose thereafter in 2022, and the 3rd Respondent has duly applied to register his succession which had been nominated by the original grantee under the original permit issued prior to the grant. Gunawardhana, J. | The Petitioner, a Society running a religious institute and Hindu Temple, was occupying a land within the vicinity of the Sri Maha Bodhi in the sacred city of Anuradhapura. Later, with the dawn of the Buddha Jayanthi era of 1956, the Petitioner was relocated by giving a land, where the Petitioner also ran a school which was vested in the Government under the Assisted Schools and Training Colleges Act. Thereafter, the Petitioner was placed in possession of another land, where it operated a religious institute including a Temple, cultural centre, and restaurant. The excess land was blocked out and given to the 8th to 10th Respondents. Dispute arose between them with regard to the regularisation and legalisation of their possession by the Government on the recommendation of the Provincial Land Commissioner, which the Petitioner objected to.
